As soon as a work is created, and provided it is original, the author benefits from intellectual property rights known as copyright. Some of these rights may be transferred, either free of charge or in return for payment, by means of a copyright transfer contract. A copyright assignment contract must be drawn up in writing and must list the rights assigned exhaustively.

Transfer of rights
The assignment contract must include the following information:
- Identity of the parties: surnames and first names of the author of the work and the beneficiary of the assignment.
- Exact description of the works concerned
- Scope of the rights assigned: the contract must specify whether the assignment relates to the right of reproduction (publishing contract), performance (performance contract), translation and/or adaptation. The fact that the words ‘etc.’ are included is sufficient for the courts to establish that the scope of the rights assigned has not been delimited.
- Destination: the contract mentions the frequency with which the work may be disseminated and in what form (medium). If the transfer of rights also covers digital exploitation of the work (on the Internet), the contract must specify this.
- Territory: the contract specifies the geographical area in which exploitation is authorised. Rights may be assigned for a particular town or region, a country or even ‘for the whole world’ (particularly if the work is to be distributed on the internet).
- Duration: the contract specifies the period for which exploitation is authorised. The assignment may be granted for the entire legal term of copyright protection. d’auteur.
- Price and payment terms
It should also always be specified whether these rights are assigned on an exclusive or non-exclusive basis. If the contract contains an exclusivity clause, the author may not grant any other transfer of his rights for the duration of the exclusivity.

The fact of having a publication on the Basse Lumière website in no way constitutes a commitment to accept the paper publication, and each author remains free to accept or not the publication in the catalogue.
